This Security Policy ("Policy") establishes the framework for security practices, user conduct, risk mitigation, and liability protections governing the use of www.hindusewa.org ("Website"), its associated platforms, membership programs, and activities conducted under the aegis of Siddh Dharmic Sewa Foundation ("Trust"), including all Kshetriya Ikais, chapters, and related initiatives ("Services").
This Policy is binding on all users, members, donors, volunteers, office-bearers, and any persons accessing or participating in the Services ("Users"). By accessing the Website or availing Services, Users expressly agree to comply with this Policy in its entirety.
1. Scope and Objectives
This Policy aims to:
- Safeguard the Trust, its promoters, chairman, core committee members, trustees, senior management, staff, volunteers, advisors, and authorized representatives ("Protected Persons") from any liability arising out of misconduct, illegal activities, or unauthorized actions by individual Users or groups.
- Ensure secure, lawful, and ethical use of the Website and Services.
- Establish clear mechanisms for detection, response, and disciplinary action against violations.
- Define exclusive jurisdiction for dispute resolution.
2. Absolute Disclaimer of Liability for Protected Persons
2.1 No Vicarious Liability: The Trust and all Protected Persons shall under no circumstances be held vicariously liable, jointly liable, constructively liable, or otherwise responsible for any act, omission, misconduct, negligence, fraud, criminal activity, tortious conduct, or illegal action committed by any User, group of Users, Ikai, or third party claiming association with HinduSewa.org, whether individually or collectively.
2.2 Independent Actions: All Users act as independent individuals or entities. Participation in membership, volunteering, or any activity does not create any agency, partnership, employment, or representative relationship with the Trust or Protected Persons. No User shall have authority to bind the Trust or Protected Persons in any manner.
2.3 Explicit Non-Involvement: Courts, authorities, or any forum shall not attribute, impute, or consider involvement of the Trust or Protected Persons in any misconduct solely based on a User's membership status, use of the Website, or loose association with HinduSewa.org.
3. Prohibited Conduct and Security Violations
Users are strictly prohibited from engaging in, facilitating, or encouraging any of the following ("Prohibited Conduct"):
3.1 Criminal Activities: Any act punishable under the Indian Penal Code, 1860, Information Technology Act, 2000, Unlawful Activities (Prevention) Act, 1967, or any other statute, including but not limited to fraud, cybercrimes, money laundering, terrorism, sedition, or public disorder.
3.2 Violence and Public Safety Threats: Participation in riots, unlawful assemblies, damage to public/private property, vigilantism, hate crimes, or any conduct disturbing public peace, communal harmony, or national security.
3.3 Hate Speech and Incitement: Publishing, sharing, or promoting hate speech, communal propaganda, fake news, defamation, or content inciting violence/discord against any religion, community, caste, or nationality on the Website, social media, or offline platforms in the name of HinduSewa.org.
3.4 Unauthorized Use of Identity: Misusing the Trust's name, "HinduSewa.org", logos, trademarks, or affiliations for personal gain, political campaigning, fundraising without authorization, or fraudulent schemes.
3.5 Data and System Breaches: Unauthorized access, hacking, phishing, malware distribution, data theft, or any attempt to compromise the Website's security, user data, or Trust systems.
3.6 Financial Misconduct: Embezzlement, misappropriation of donations/fees, fake receipts, or non-transparent handling of funds collected under the guise of HinduSewa.org activities.
3.7 Harassment and Abuse: Cyberbullying, stalking, threats, impersonation, or discriminatory behavior targeting other Users, staff, volunteers, or the public.
4. User Obligations and Affirmative Covenants
4.1 Each User covenants to:
- Comply with all applicable laws, this Policy, Terms & Conditions, and Code of Conduct.
- Use Services only for lawful, peaceful, and constructive purposes aligned with the Trust's mission of sewa and social welfare.
- Report any suspected Prohibited Conduct or security threats immediately to designated Trust contacts.
- Maintain confidentiality of any sensitive information accessed through Services.
4.2 Users shall indemnify, defend, and hold harmless the Trust and Protected Persons from all claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising from their Prohibited Conduct or breach of this Policy.
5. Detection and Monitoring Mechanisms
5.1 The Trust employs automated tools, manual reviews, and reporting systems to detect potential violations, including:
- Content moderation on Website forums/comments.
- Transaction monitoring for unusual donation patterns.
- IP tracking and access logs for security incidents.
- User reports and whistleblower mechanisms.
5.2 The Trust reserves the right (but not obligation) to monitor communications and activities to ensure compliance, subject to applicable privacy laws.
6. Disciplinary Actions and Consequences
6.1 Immediate Termination: Upon detection or credible report of Prohibited Conduct, the Trust reserves absolute discretion to:
- Suspend or permanently terminate the User's membership, access, or privileges with immediate effect.
- Dissolve or disaffiliate any Ikai/chapter involved.
- No refunds of membership fees, donations, or contributions shall be made under any circumstances.
6.2 Debarring: Debarred Users shall have no right to rejoin, associate, or claim benefits from HinduSewa.org. Their details may be shared with law enforcement if required.
6.3 No Appeal for Cause: Decisions on termination/debarring for Prohibited Conduct are final; appeals are permitted only for clerical errors, not substantive review.
6.4 Public Disclaimer: The Trust may issue public statements dissociating from any User's actions and clarifying non-involvement of Protected Persons.
7. Incident Reporting and Response Protocol
7.1 Users must report incidents via:

7.2 The Trust's Security Committee (comprising trustees/core team) shall investigate promptly, cooperate with law enforcement, and take remedial action.

8.1 Technical Safeguards:
- HTTPS encryption for all data transmission.
- Firewalls, intrusion detection, and regular security audits.
- Secure payment gateways (PCI-DSS compliant).
- Role-based access controls and audit trails.
8.2 Physical and Administrative Controls:
- Data stored in India-based secure servers.
- Employee/volunteer training on security best practices.
- Regular backups and disaster recovery plans.
8.3 Users must use strong passwords, enable 2FA where available, and avoid sharing credentials.
9. Governing Law and Dispute Resolution
9.1 This Policy shall be governed exclusively by the laws of India, as amended from time to time.
9.2 Exclusive Jurisdiction: All disputes, claims, or differences arising out of or in connection with this Policy, Services, or any User's conduct shall be subject to the exclusive jurisdiction of the competent courts in Delhi/New Delhi only. Parties irrevocably waive objections to venue or forum non-conveniens.
9.3 No arbitration, mediation, or alternative dispute resolution shall apply unless expressly agreed in writing by the Trust post-incident.
10. Miscellaneous Provisions
10.1 Severability: If any provision is held invalid, remaining provisions remain enforceable.
10.2 Waiver: No waiver of any breach shall constitute waiver of subsequent breaches.
10.3 Amendments: The Trust may amend this Policy at its sole discretion; continued use constitutes acceptance.
10.4 Entire Agreement: This Policy supersedes prior understandings on security matters.
